Official reasons for ineligibility of candidates

Following the decision of the Fecafoot Electoral Commission published on November 20, only one candidate has been declared eligible for the elections, Tombi a Roko Sidiki.

The other candidates were told to complete their files within 72 hours after which they were declared ineligible.

But, www.lions4life.com has learnt that the Prime Minister instructed that Prof. Joseph Owona should do everything for another candidate to get eligibility for the elections to take place on a level ground.

This explains why the candidates have been given another four days until November 26 to complete their files for elections on November 29.

These are the reasons for the disqualification of the other candidates: DECISION NO 232/FCF/PCN/STCE/2014 ON THE ELIGIBLITY OF CANDIDATES FOR FECAFOOT ELECTIONS

CONSIDERING the constitution of the Republic of Cameroon; • CONSIDERING Law No 2011/18 of the 15th of July, 2011 relating to the organising and the promotion of sporting activities;

• CONSIDERING the statutes and internal rules and regulations of FECAFOOT;

• CONSIDERING the decision of the 3rd of July, 2013 of the Emergency Committee of FIFA notably the Normalisation Committee of FECAFOOT;

• CONSIDERING the FIFA correspondence of the 20th of July, 2013 putting in place of the Normalisation Committee;

• CONSIDERING the exceptional circumstances that created the Normalisation committee;

• CONSIDERING the decision of the Normalisation Committee of the 30th of July, 2014 fixing the electoral calendar of the Electoral process of FECAFOOT and its decentralised leagues;

• CONSIDERING the decision No 052/FCF//PCN/2014 of the 13th of August, 2014 relating to the creation, Organisation and functioning of the Technical Secretariat attached to the electoral commission of FECAFOOT and its leagues;

• CONSIDERING the decision No 053/FCF/PCN/2014 creating the technical committee attached to the electoral commission of FECAFOOT and its leagues;

• CONSIDERING sections 10 and 11 of the Electoral Code of FECAFOOT;

• CONSIDERING section 2 of annexed texts of FECAFOOT;

• CONSIDERING section 35, 36 and 45 of statutes of FECAFOOT;

• CONSIDERING the Directives No 004/FCF/PCN/2014 relating to some provisions of the electoral code;

• CONSIDERING the candidatures filed by Messrs, ATAH Robert BAHAZAH, BELL Joseph Antoine, MEBANDE Bright épse ABDOUL BAGUI, NYONGHA Jules Frederic, PENNE Robert and TOMBI A ROKO SIDIKI;

THE ELECTORAL COMMISSION CONSIDERING the Directives No 004/FCF/PCN/2014 relating to the execution of some provisions on the deadline for the deposition of candidatures, fixed for the 17th November, 2014 at 3:00pm;

CONSIDERING the candidatures filed by Messrs, ATAH Robert BAHAZAH, BELL Joseph Antoine, MEBANDE Bright épse ABDOUL BAGUI, NYONGHA Jules Frederic, PENNE Robert and TOMBI A ROKO SIDIKI which were received and registered, then transmitted to the Electoral Commission as prescribed for by Law;

CONSIDERING that the candidatures were deposited on time and on the date as prescribed for by law,

There was need for the files to examine;

CONSIDERING that the list filed by Mr. ATAH Robert BAHAZAH was comprised of the following persons;

ON POINTS OF LAW

CONSIDERING that section 35 of the FECAFOOT Statutes states as follows:

“1. The Executive Committee shall be made up of 18 (eighteen) members, including at least one female member, distributed as follows:

a) the President of FECAFOOT;

b) a first Vice-president;

c) a second Vice-president;

d) the President of the Professional Football League of Cameroon;

e) 14 (fourteen) representatives of regional leagues, distributed as follows :

f) A representative of each of the ten (10) regional leagues.

– Adamaua region, 1 (one) representative;

– Centre region, 2 (two) representatives;

– East region, 1 (one) representative;

– Far- North region, 1 (one) representative;

– Littoral, 2 (two) representatives;

– North region, 2 (two) representatives;

– North-West region, 2 (two) representatives;

– West region, 2 (two) representatives;

– South region, 1 (one) representative ;

– South-West, 1 (one) representative;

The Vice-presidents shall in any case be, one French-speaking, the other one English-speaking

1. The President and other Executive Committee members, excepting the President of the Professional Football League of Cameroon, shall be elected by list ballot. This list must include a minimum 11 (eleven) delegates to the General Assembly and can contain up to 6 (six) personalities not delegated to this Assembly.

2. Candidacies shall be sent to the General Secretariat of the FECAFOOT at least 60 (sixty) days before the date of the General Assembly. The Secretary-General will inform members and shall make public the lists formalized by the Electoral Commission 15 (fifteen) days before the date of the General Assembly. The official lists of candidates must reach members of FECAFOOT with the agenda of the General Assembly at which the election of the Executive Committee is scheduled 7 (seven) days before the date of the General Assembly”.

“That section 36 conditions of eligibility

1. Every candidate for membership of the Executive Committee of FECAFOOT must meet the eligibility requirements below:

a) be a Cameroonian citizen enjoying his civil rights;

b) have reached the age of majority;

c) reside in Cameroon;

d) not to have been finally convicted of a felony, even by default;

e) not to have been sentenced to a definite term of imprisonment exceeding 3 (three) months without suspension;

f) not to have been sentenced to a definite term of imprisonment subject to a suspended sentence or probation of more than 6 (six) months;

g) not to be an undischarged insolvent whose bankruptcy has been declared either by a Cameroonian court or by a judgment rendered abroad and enforceable in Cameroon;

h) not to present mental disorders recognized by a panel of expert medical specialists in the courts;

i) not to have been convicted of acts contrary to the dignity of the management activity of a sports association (especially doping, corruption, forgery, etc.) within 5 (five) years;

j) never to have been denied discharge of his management nor to have been charged with mismanagement by a decision that became final by a competent body;

k) not to have been convicted within five years prior to the elective General Assembly to a penalty of suspension of 2 (two years) years minimum on matters of discipline and/or infringement of sporting ethics by a adjudicating organ;

l) not to be a debtor of money or securities in respect of FECAFOOT or an association affiliated to FECAFOOT or approved by it.

A member of the Executive Committee may not simultaneously be a member of a judicial body of FECAFOOT or delegate to the General Assembly”.

Article 45: Specific conditions for the eligibility of the President of FECAFOOT, Chairman of the Executive Committee

1. Any Cameroonian of either sex aged at least 40 (forty), meeting the general eligibility requirements set forth in these Statutes, and who is either a delegate to the FECAFOOT General Assembly or who has previously been sponsored by at least 8 (eight) delegates to the said Assembly may be candidate to the presidency of FECAFOOT.

2. The Outgoing President shall be allowed to stand as a candidate without sponsorship, subject to the conditions for eligibility provided in these Statutes.

Any candidate for the presidency of FECAFOOT must pay a deposit of 2,000,000 FCFA (two million) by certified cheque payable to FECAFOOT upon filing the application. The candidate who gets 20% of the votes shall be reimbursed.

1- ON THE CANDIDATURE OF ATAH ROBERT BAHAZAH CONSIDERING that the declaration of candidature by Atah Robert for the post of Executive President of FECAFOOT is made up of the persons as listed above; CONSIDERING that the said list produced by him doesn’t have a single delegate mandated by a General Assembly, this is in violation of sections 35 of the statutes of FECAFOOT above cited;

CONSIDERING further that the conditions laid down in section 36 of the FECAFOOT statutes above cited, relating to the filing-in of a certificate of non conviction and a certified true copy of a national identity card, were not done by Atah Robert for the post of the 1st and 2nd Vice Presidents and also for the other persons on his list;

CONSIDERING also that the provisions of section 45 of FECAFOOT statutes relating to the filing of a letter of sponsorship and a deposit of 2.000.000 frs CFA were not complied with by Atah Robert;

That he was informed to regularise his file by completing his documents within a time frame of 72 hours as provided for on paragraph 2 of the Directives No. 004 cited above, yet Mr. Atah Robert did not comply;

Consequently his candidature was declared ineligible;

2- ON THE CANDIDATURE OF BELL JOSEPH ANTOINE CONSIDERING that the declaration of candidature by Bell Joseph Antoine for the post of Executive President of FECAFOOT showed a list of 13 names instead of 17, not including the delegate of the Professional Football League, a member as of right, as provided in Section 35 of the FECAFOOT statutes above cited;

That he was requested to regularise his file by completing his documents within a time frame of 72 hours as provided for on paragraph 2 of the Directives No. 004 cited above, on the contrary, Mr. Bell Joseph Antoine brought in a new list of 12 persons;

That as concerns Bell’s first list, Mr. TABALI Bernard doesn’t figure anymore on his list, on the contrary, Mr. IKOME William Lifange replaced Mr. BILL MOSAH on his list;

That Bell equally furnished certified true copies of national identity cards and non conviction certificates of the persons found on his list;

CONSIDERING that the said list produced by him does not have a single delegate mandated by a General Assembly, was in violation of sections 35 of the statutes of FECAFOOT above cited;

CONSIDERING also that he did not provide any letter of sponsorship vitiates the provisions of section 45 of FECAFOOT statutes mentioned above;

Consequently his candidature was declared ineligible;

3- ON THE CANDIDATURE OF MME MEBANDE BRIGITTE epse ABDOULBAGUI CONSIDERING that the declaration of candidature by Mme MEBANDE Brigitte epse ABDOULBAGUI for the post of Executive President of FECAFOOT was made up of a single name and which was hers;

That the conditions under section 35 of the statutes of FECAFOOT above cited were violated;

That she was informed to regularise her file, by completing her documents within a time frame of 72 hours as provided for on paragraph 2 of the Directives No. 004 cited above, yet Mme MEBANDE Brigitte did not comply;

CONSIDERING also that the provisions of section 45 of FECAFOOT statutes relates to the payment of a deposit of 2.000.000 frs CFA by each candidate, she did not comply with this condition as well;

Consequently her candidature was declared ineligible;

4- ON THE CANDIDATURE OF NYONGHA JULES FREDERIC CONSIDERING that the declaration of candidature by Nyongha Jules Frederic for the post of Executive President of FECAFOOT deposited on the 17th of November 2014, carried only his name in his capacity as the only President of the Executive Committee of FECAFOOT;

That he was informed to regularise his file by completing his documents within a time frame of 72 hours as provided for on paragraph 2 of the Directives No. 004 cited above, Mr. Nyongha Jules Frederic instead brought in a new list of a declaration of candidature comprising 8 persons, plus 2 Vice Presidents and himself giving a total of 11 persons instead of 17. This figure did not include the President of the Professional Football League, having statutory rights, as provided for in Section 35 of the FECAFOOT Statutes;

That he has furnished a non conviction certificate of Mr. DAHIROU DJINTOUING and certified true copies of national identity cards of himself, and that of Mr. MOUSSINGA BOJONGO Lucien Michel;

That Nyongha Jules equally furnished a receipt of a deposit of 2.000.000 frs CFA;

CONSIDERING that the provisions of Sections 35, 36, and 45 relating to: the composition of a list of members of the Executive Committee of FECAFOOT, the establishing of non conviction certificates, certified true copies of national identity cards and obtaining of letters of sponsorships, these documents shall be compiled by all those persons found on his list, but these conditions were not fulfilled by Nyongha Jules Frederic;

Consequently his candidature was declared ineligible;

5- ON THE CANDIDATURE OF PENNE ROBERT CONSIDERING that the declaration of candidature by PENNE Robert for the post of Executive President of FECAFOOT deposited on the 17th of November 2014, had only two names, i.e. PENNE Robert and FEUTCHEU in their respective capacities as President of the Executive Committee of FECAFOOT and the 1st Vice President;

That he was informed to regularise his file by completing his documents within a time frame of 72 hours as provided for on paragraph 2 of the Directives No. 004 cited above, Mr. PENNE Robert instead filed in a new list of declaration of a candidature comprising 8 persons, plus 2nd Vice President, making a total of 11 persons instead of 17. This list did not include the President of the Professional Football League, as provided for in Section 35 of the FECAFOOT Statutes above cited;

That he furnished 6 letters of sponsorships instead of 8, 2 non convictions for WAMBA NGAKOU Joseph and NOUCK Protus BILAP and also certified true copies of national identity cards of ONGANDZI MESSINGA Vincent de Paul et SEMENGUE BITOMO Stephanie Thomas;

That PENNE Robert did not pay his deposit of 2.000.000 frs CFA as required by law;

CONSIDERING that the provisions of Sections 35, 36, and 45 relating to: the composition of a list of members of the Executive Committee of FECAFOOT, the establishing of non conviction certificates, certified true copies of national identity cards and obtaining of letters of sponsorships, these documents shall be compiled by all those persons found on his list, but these conditions were not fulfilled by PENNE Robert;

Consequently his candidature was declared ineligible;

6- ON THE CANDIDATURE OF TOMBI A ROKO CONSIDERING that the declaration of candidature by TOMBI A ROKO for the post of Executive President of FECAFOOT constituted 17 members as above cited, it did not include the Delegate of the Professional Football League, a statutory member, his list comprised:

Representatives of the 10 regional leagues of FECAFOOT, in compliance with the quota fixed for in Section 35(1)(e) of the FECAFOOT Statutes;

– 2 Vice Presidents, one a Francophone and the other an Anglophone;

– A Woman in the person of NKENGAFE PRUDENCIA ASONGASHA, delegate of the South West General Assembly, regularly co-opted;

That all the conditions laid down in Section 45 of the Statutes of FECAFOOT above cited have been fulfilled by TOMBI A ROKO;

That Section 45 of the FECAFOOT statutes relating to letters of sponsorships and the payment of a deposit were provided by TOMBI A ROKO;

That TOMBI A ROKO did produce 12 letters of sponsorships and has paid his deposit of 2.000.000 frs CFA as evidenced by a receipt from BICEC found in his file;

Consequently his file was complete and his candidature declared eligible;

RULING

Article 1:

Declare ineligible the lists headed by ATAH Robert BAHAZAH, BELL Joseph Antoine, MEBANDE Bright épse ABDOUL BAGUI, NYONGHA Jules Frederic, PENNE Robert;

Article 2:

Declare on the contrary eligible the list headed by TOMBI A ROKO as follows:

1- TOMBI A ROKO (President)

2- BOUBAKARI BELLO (1st Vice-President)

3- MBELLA MOKI CHARLES (2nd Vice-President)

4- ABBO MOHAMADOU (Adamawa Delegate)

5- KOA LUC (Centre Delegate)

6-NGUINI CHARLES (Centre Delegate)

7- KORONDO MBELE (East Delegate)

8- ABDOUSALAM MOHAMAN (Extreme-North Delegate)

9- BATAMAK PIERRE JOSEPH (Littoral Delegate)

10- NGANING MATHIAS SYLVESTRE (Littoral Delegate)

11- ABOUBAKAR ALIM KONATE (North Delegate)

12- HAROUNA NYAKO (Nord Delegate)

13- KABA CHRISTOPHER ATANGA (North West Delegate)

14- WEMBE SAMUEL (West Delegate)

15- TAMO ETIENNE CLAUDE (West Delegate)

16- ZAM JEAN JACQUES NOEL (South Delegate)

17- NKENGAFE PRUDENCIA ASONGACHA (Delegate South West General Assembly)

Article 3:

The candidates shall be informed of the respective decisions of ineligibility and eligibility upon signing of the present decision.

Article 4

This present decision shall be published when and where ever need arises.
